Well, this law professor at Pitt thinks it's a potential problem to have a non-profit educational institution running a pro-athletic program. I've been wondering about this myself for quite awhile. Will have to see what type of rulings come down from the IRS and then, if that happens, what the courts have to say about it. All the other employees of a university have some function that is directly or indirectly related to the university's educational mission. Even the groundskeeper and dormitory cook have that kind of nexus with education. With a football or basketball player the nexus is a little more tenuous. IRS is getting their share. More an issue of the NLRB, their interpretation and the courts. Your opinion here would mean that the Presidents of basically every major public university just set off a sequence of events that will result in universities losing their tax exempt status. And that with all of their very expensive, white shoe lawyers, lobbyists, and connections into state houses and congress, nobody thought about this but a professor at the 91st ranked law-school in the country. I guess you can't help yourself, but no it's not the current SCOTUS. He retired several years ago, though he still has an active law license and does some work for the current AG on a contract basis. The most notable case he won in front of SCOTUS was in the last century and involved Ohio tax law and an attempt by the auto industry to exempt themselves from a particular tax. They lost, and SCOTUS ruled that the tax applied to them. It was a highly technical case, and I don't remember any of the details. I have a reprint of that case somewhere. He was kind of proud of it, and distributed copies to family members. As I recall, it was a 9-0 decision. He also has done some pro bono work for family members, including recently getting UPS to pay an insurance claim I had against them for a package stolen off the recipients porch that required a signature, which wasn't obtained. UPS was trying its best not to pay, until they received a letter from my brother-in-law with all kinds of slick legal wording, and saying I had retained him to file a law suit on my behalf. I then got the insurance check within 78 hours of UPS receiving that letter. Aren't you glad you asked? They were putting up every roadblock you could imagine. I think they were hoping that I would just give up frustrated that I couldn't navigate their bureaucracy. I kept getting bounced from one department to another all asking for the same documentation all over again and claiming that they had no record of what the previous department had received. This had been going on for about a month. It was a complete nightmare. One letter from my high-powered lawyer ended it all! BVP and Sears seem like outliers at this point. We had no NIL collective and they were premium/established talents. There was probably no keeping Sears regardless from going back home. BVP gave us 4 years. We kept AJC and Shareef, who were likely the biggest threats to jump. The best case for Kuany after a redshirt would be a lateral move. I seriously doubt that happens since his visa would be an issue if he ended up elsewhere. Firstly, where would he go? He's not going to have any film, so no one's going to know what they're getting into. Secondly, the minutes look like they'll be available next year with two rotation bigs exhausting eligibility. Redshirting when he hasn't been around for summer workouts and other team activities is the right call. Even in this era of easy player movement, you still need to do right for the kid.
