Anybody remember Melvin Payne?

He's the former Ohio redshirt freshman linebacker who Athens Police accused this past May of illegally entering the home of another student (apparently a complete stranger). Payne allegedly ran through a glass door when confronted, left a trail of blood back to his pad, claimed he'd been stabbed to get local medical treatment and then skipped town by bus. Within days, he had reportedly worked things out to come back to Athens and face the music. He was charged with felony burglary, and his case was bound over to a grand jury. Locally, this involves transferring the case from Athens County Municipal Court to Athens County Common Pleas Court.

OK, here's what I don't understand: I just checked the Athens County Common Pleas Court Web docket, and Payne's case is nowhere to be found. Meanwhile, he is playing defensive end for Fort Scott Community College in Kansas. If the grand jury didn't find enough evidence to indict him on the burglary rap, I'm told that prosecutors would seldom try again, i.e., amending the charge to trespassing or breaking and entering (OK, I guess in his case it'd be more like entering and breaking.) But AFAIK our slumbering news-non-gatherers never reported that the grand jury didn't indict (unless I missed something). Just curious.

Ace reporting on your part, PF.  One wonders if his case is no more than a misdemeanor if he'll transfer back to FBS or FCS next season.  When I first read about this story I assumed that he was going to spend some time in the slammer, but the details seem to get murkier as time goes on.

I DO NOT know any details about this case, but I believe that judiciaries do not need a grand jury indictment to take action.

Also, Grand Jury Indictments do not show up on the docket that many search.

Right. A simple call or visit to the courthouse would resolve this. I was just wondering if anybody knew the case status and thought it was interesting that he had bulked up to play a different position and was able to crack the lineup and be one of the better defensive players at another school so quickly.

I agree it is interesting. Perhaps a local reporter type will follow up on it.

Sometimes cases can fall apart if a witness decides not to cooperate with the prosecution. Just guessing here.

(Didn't something similar happen with Serggio Judkins and his legal troubles? A lot of embarassing publicity in these cases initially, but no follow up media-wise on the jurisprudence.)

FYI...he was being switched to defensive end at Ohio as well. I don't recall if this incident happened post Spring practice or not. If it did, he had already switched positions. With Dak, T. Scott and Meyers hobbled, we could use him from the personnel standpoint for sure.
