As the fall football season rolls in, the crazies on High Street are now seeking to patent the THE in The Ohio State University. That seems to be an effort to make it more official (and money-making) and we all know OSU is not the only Ohio state university nor even the best, but cleans up on football tees, etc. OU officials should watch the move closely as more and more of OSU tee shirts simply say Ohio and might be in violation of the old lawsuit ruling. A counter move: OU should come back with a new tee that says
The Classy Ohio University.

I would never defend OSU on any grounds.

But I have seen shirts at places like Walgreens and Wal-Mart selling t-shirts that say Ohio in red on a gray shirt and vice-versa that are not licensed by anyone.

Some of the beer bottlers are the worst, too. They will say "Ohio Football" or something like that with an OSU schedule printed below on a poster. Usually some clever wording that they think is bypassing one trademark only to be infringing on another.

Not knowing the exact language of the rights by our beloved university, I don't know if the language, colors etc. are all a part of the approval but I think a lot of businesses try to capitalize on all things Ohio State fandom with anyone on the Olentangy even aware of what they're doing. I also doubt they do much to stop them if it's not one of their names/wordmarks/logos being used.

What I can say with confidence is it's moves like this that makes anyone who is not an Ohio State fan likely to find them at the top of the douche-bag list.

Zero chance of being granted the trademark - simply not proprietary - just ask The U. Maybe OSU will try to trademark University next.

Although Ohio should certainly trademark Fuck Miami.... I mean Muck Fiami.

Disagree, under certain usages I bet the trademark is granted. Willing to bet the request is not all encompassing of the word The
Just like Miami, they have certain aspects of the usage of the U trademarked, but not a blanket on the letter. In some instances they even have coverage of “You”

In Ohio folks may associate The with OSU - not anywhere else. - don't see it - as you said, perhaps when situated with "Ohio State University" elsewhere on the apparel, but not stand alone. They just don't have the standing - according to trademark lawyers that are chiming in.

Because just the word "THE" is not a logo that O$U has ever used. It's always "THE" with something else. You have to at least use it by itself -- like the word "Ohio" -- before you can try to trademark it. Just plain greedy.

The College Bookstore is advertising for sale on their website a red heather t-shirt with the word “AN” and the “tm” trademark along side of it, with the suggestion that Ohio State trademark that word instead. I LOVE IT!!!

Perhaps, Ohio should use "one and only" ahead of it's name in response. Likewise, "The" Ohio State only needs to win another National Championship or two rather than being a continued doormat for others in that category to become relevant again. They, of course, could also continue to have a scandal or two in the sake of name recognition. Unfortunately, it would be tough to replace Penn State in that particular category.

If I owned College Bookstore, I'd immediately be on a design that has an arched "THE" over the arched "OHIO", assuming the new AD/Michael Stevens approved of that design relative to our trademark guidelines.

And if they didn't, and if I owned Uptown Dog, I'd have created this design years ago, and waited for the cease and desist.

I always like the "OHIO the State University" shirts, and still have one to this day.

Last Friday, I went to a Lake Erie Crushers game (independent league) in Avon. Unbeknownst to me and my wife, it was Ohio State night, complete with that walking abomination "big nut" and the Ohio State alumni marching band. We, of course, had seats right in front the band.

After the 3rd or 4th rendition of hang on sloopy, I walked up to one of drummers, and wearing my Ohio hat said "Clearly, you guys are showing that you weren't talented enough to get into the Marching 110"

He wasn't amused.

So it is a Monday night NFL game. They are running the intros for the players. Nick Chubb says, "Nick Chubb, THE University of Georgia"

Does anyone here expect OSU to sue him for using "THE" -- or do you feel he has the right and it is acceptable for him to say "THE University of Georgia" - if it is okay, then OSU is acknowledging they have very, very limited grounds to trademark "THE"

I actually drove by that stadium on my recent trip to Independence, Ohio, and then to Put-in-Bay.

In Independence, at the National Encampment of the Sons of Union Veterans, I ran into one delegate who was wearing an Ohio State cap. As he was going down the hall in front of me, some other folks in the hallway started the OH-IO thingy. I said in a very loud voice, "Oh, you're talking about the junior institution in Columbus? I then said, "The real OHIO is in Athens." They were quite stunned. They tried to start up the chant again, I repeated my statement, and they stopped short. This dude was also a delegate at the encampment, and he was the only one who never put on some Civil War related clothing and/or hat. He continued to wear his OSU hat throughout the proceedings. He stuck out like a sore thumb. I wonder if he did that just to irritate me, or if he was just naturally irritating all the time. I suspect the latter, just one of your common, run-of-the mill obnoxious bandwagon A&M lemmings.

Its not just OSU who seems a bit carried away with trademarking things.

There's an article in today's paper that Rutgers has "asked" a Louisiana high school to change their logo.

Seem Ruston High School used the same now trademarked block "R" as Rutgers.

The article says the school got a "cease and desist " letter about the logo.

First off,Rutgers doesn't exactly set the world on fire with merchandise
sales.
Second,its a high school far removed from RU.

I know a bunch of die hard RU fans.
They all think this is a bit much.

What’s wrong with that? It is the property of Rutgers! Wisconsin Sent same letter to Warren several years ago. IMO, we should do more to protect our Mark as well, we paid a lot of money to design that mark to just give it away.

Legally,there's absolutely nothing wrong with.

Just seems a bit petty for a New Jersey University to be that concerned that a local public high school in a small Louisiana town is using their trademarked logo.
Especially since,if the news stories are correct,they've been using the
logo since before RU trademarked it.
