If true I'd think that would solidify the redshirt option. One of the new guys was likely headed that way. This may make the decision for them.

That would be a bummer, I know we were all excited about the additional length. Even Boals was anticipating him playing (at least by his quote on the signing) and contributing this season.

I won't pretend to know the ins and outs of the student visa, but didn't he play in WV last season? How long could it take to extend a student visa? Is it the state of Ohio thats holding it up?

My question as well concerning the visa.

Very disappointing if he's not available for 2024-2025. It never sounded like Boals was going to red-shirt him.

Depends on which country he’s applying through, every nation has different deals with the US Government. I believe he’s a dual citizen of Australia and South Sudan, or at least I know his brothers are.

And I believe his Visa last year would be a different one this year due to that one being a HS year, and now would have to apply for a college student visa.

On a different tangent, doesn't a student visa prevent him from earning NIL $$?

Can someone please let us know what the issue is with Kuany.
Has he officially enrolled? Has he transferred out? What's what?

Why does he need a visa? Have him cross the southern border as an illegal immigrant. They will bus him to Athens free of charge and pay him $5,000/ month that will be good nil money! He would make out better than most players!

Or fake an assassination on the kid where he gets a scratch on his ear and then he puts a feminine hygiene product on it which makes it magically grow back like a salamander. Then have a disbarred drunk former doctor make up a false statement about it. Then the "security" gets put on paid time off to go get this...

Yes. I am part owner of a business in Dayton. The business signed the first NIL deal with UD. It involved basketball players sending out tweets. For those that were on student visas, they had to wait to be in their homeland to send the tweets and get paid. Tournaments in Jamaica or the Bahamas have also been used as a way to pay those on student visas. Have a cookout during the tournament and pay a player $200K to appear.

May be wrong, but I believe Purdue played a basketball game in Canada last winter to benefit Zach Edy, a Canadian on a student visa.

It seems to me that this is the reductio ad absurdum for the whole NIL Era. Pay for tweets, or are they now Xs? And foreign nationals need to wait and tweet when out of the country. Does anyone think that this paradigm for college athletics will last very long?

Here's a thoughtful piece about the mess we may be getting ourselves into:

Key Quote at the very end of the article from a Pitt law professor:
“Getting dollars to athletes for the real work that they do is important,” Hackney said. “But once you’re starting to pay them, you’re no longer operating a charity where you’re honestly there to educate these athletes. You’re there to pay them for a transactional business that’s not charitable anymore.”

Universities have employees. A lot of them. How does the fact that a subset of students also get paid fundamentally change the mission of a university?

Well, this law professor at Pitt thinks it's a potential problem to have a non-profit educational institution running a pro-athletic program. I've been wondering about this myself for quite awhile. Will have to see what type of rulings come down from the IRS and then, if that happens, what the courts have to say about it.

All the other employees of a university have some function that is directly or indirectly related to the university's educational mission. Even the groundskeeper and dormitory cook have that kind of nexus with education. With a football or basketball player the nexus is a little more tenuous.

What's the definition of a "pro" athletic program? As it relates to non-profits, simply having employees and generating revenue doesn't preclude non-profit status, and what's more relevant is how the money is spent. For the most part, it has to be reinvested into the organization and can't go to enriching shareholders/officers, etc.

In this regard, how is paying Johnny Manziel any different than paying his coach?

What is Tim Albin's role in the educational mission of the University? Urban Meyer's spiritual advisor? Strength coach? Justify them, and then do the groundskeeper and dormitory cook.

For years, the folks arguing against change to NCAA athletics have insisted that athletics are a staple of the college experience, and essential to the culture of Universities, and to churning out well-rounded graduates. And now suddenly that same crew can't make the case that Caitlyn Clark contributed to the mission of the University of Iowa but a groundskeeper does? And why? Because Iowa might send the next Caitlyn Clark a W2?

Color me very, very skeptical that the social benefit of higher education is completely eliminated by a revenue share with the people who generate the revenue.

Though, I guess it's also possible that the Presidents of every P5 school just signed off on a revenue share plan and every single one of them forgot to ask their lawyers if they'd lose their non-profit status by doing so.

Considering it’s an IRS tax code and immigration law, yeah, it won’t change over night. No local judge is getting in the way of the IRS, mainly because they can’t.
